Daly Strategic Recruiting: Comprehensive Legal Notice (2026)

Section I: Terms of Use & Service Agreement

1.1 Binding Agreement Access to and use of dalystrategicrecruiting.com (the "Site") are subject to the following terms and conditions and all applicable laws. By accessing the Site, you accept, without limitation or qualification, these Terms of Use.

1.2 Scope of Agency Services Daly Strategic Recruiting acts as an intermediary between hiring entities ("Clients") and job seekers ("Candidates"). The issuance of this notice confirms that the Agency does not guarantee employment for any Candidate nor the suitability of any Candidate for a Client.

1.3 Intellectual Property All content, including but not limited to text, graphics, logos, and software, is the property of Daly Strategic Recruiting and is protected by United States and international copyright laws. Unauthorized reproduction or "scraping" of job listings via AI automated tools is strictly prohibited without express written consent.

Section II: Data Privacy & 2026 Regulatory Compliance

2.1 Data Privacy Standards In accordance with the California Privacy Rights Act (CPRA) and updated 2024-2026 data sovereignty guidelines, Daly Strategic Recruiting employs end-to-end encryption for all candidate dossiers and "PII" (Personally Identifiable Information).

2.2 AI and Automated Decision-Making Pursuant to 2026 transparency mandates, Candidates are hereby notified that Daly Strategic Recruiting may utilize AI-augmented sorting tools to categorize resumes. However, final "Right of Representation" and "Finalist Selection" are conducted by human administrative professionals to ensure equitable evaluation.

2.3 Data Retention Policy Candidate data is retained for a period of twenty-four (24) months from the last point of contact, after which it is subject to secure digital shredding unless the Candidate provides an affirmative "Opt-In" for extended database inclusion.

Section III: Candidate Representation & Liability Disclaimer

3.1 Accuracy of Information Candidates are legally responsible for the veracity of their credentials, including phlebotomy certifications, medical billing diplomas, and employment history. Daly Strategic Recruiting reserves the right to terminate representation immediately if "Credential Inflation" or fraudulent documentation is detected.

3.2 Limitation of Liability Daly Strategic Recruiting shall not be held liable for any "Incidental" or "Consequential" damages arising from the interview process, background checks, or the eventual termination of employment between a Client and a Candidate.

3.3 Indemnification You agree to indemnify, defend, and hold harmless Daly Strategic Recruiting from any claims, losses, or expenses (including legal fees) resulting from your violation of these terms or your professional conduct during the placement process.

 

Privacy Policy & California Consumer Privacy Act (CCPA) Disclosure

Daly Strategic Recruiting (“the Agency,” “we,” “us”) provides this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and the California Privacy Rights Act of 2020 (CPRA). This policy applies to all job applicants, candidates, and website visitors residing in the State of California.

Categories of Personal Information Collected:

  • Identifiers: Name, alias, postal address, unique personal identifier, online identifier, IP address, email address, and Social Security number (collected only upon conditional offer).
  • Professional/Employment Data: Resume, CV, work history, certification status (e.g., Phlebotomy, Medical Billing), and performance evaluations.
  • Education Information: Transcripts, diplomas, and records from Community College, or other institutions.
  • Sensitive Personal Information: Precise geolocation, racial or ethnic origin (voluntary for EEOC compliance), and health information related to workplace accommodations.

2. Automated Decision-Making Technology (ADMT) Disclosure

Pursuant to the 2026 California privacy mandates, we hereby disclose our use of technology in the vetting process:

  • Purpose: The Agency may use algorithmic parsing to categorize resumes based on technical skills (e.g., Salesforce proficiency or Billing certifications).
  • Opt-Out Rights: California residents have the right to opt-out of automated decision-making that has significant legal or life effects.
  • Human Oversight: Unlike fully automated "black-box" systems, Daly Strategic Recruiting maintains a Human-in-the-Loop policy. No candidate is disqualified solely by an algorithm without manual review by a recruitment professional.

3. Your Rights Under the CPRA (2026 Standards)

As of January 1, 2026, California residents have the following expanded rights:

  • Right to Know (Expanded Lookback): You may request access to personal information collected about you going back to January 1, 2022. We must provide this data in a portable, easily readable format.
  • Right to Correct: You have the right to request that we correct any inaccurate personal information we maintain, including updates to your professional certifications or contact details.
  • Right to Delete: You may request the deletion of your candidate profile, subject to certain legal exceptions (such as maintaining records for payroll or tax audits).
  • Right to Limit Use of Sensitive PI: You may direct us to limit the use of your sensitive personal information to only those services necessary to perform the recruitment and placement process.

4. No Sale or Sharing of Personal Information

Daly Strategic Recruiting does not "sell" your personal information to third parties for monetary gain. We "share" information only with prospective employers (Clients) for the sole purpose of securing your employment. We honor the Global Privacy Control (GPC) signal; if your browser sends a GPC signal, our site will automatically treat it as a request to opt-out of any data sharing.

5. Data Retention & Security

We retain candidate data only for as long as is necessary to fulfill the recruitment purpose or to comply with California labor laws.

  • Security: We utilize industry-standard AES-256 encryption for all stored resumes and PII.
  • Minors: Our services are not directed at individuals under the age of 16. In accordance with 2026 laws, any data from minors is automatically classified as Sensitive Personal Information requiring affirmative "Opt-In" consent.
